SmartCare Loyalty Scheme Terms & Conditions

Introduction

  1. The Smart Care Loyalty Scheme terms and conditions are set out below. These terms together with the privacy policy govern the Smart Care Loyalty Scheme.
  2. The Smart Care Loyalty Scheme is promoted by Domestic & General Services Limited (company number 01970780, with its registered office at 11 Worple Road, Wimbledon, London SW19 4JS) and provided by Whirlpool UK Appliances Limited (company number 001606725, with its registered office at Morley Way, Peterborough PE2 PJB).
  3. Please note that participation in the Smart Care Loyalty Scheme will be considered as acceptance of these terms and conditions and privacy policy.
  4. Eligibility for the scheme

  5. As a reward for purchasing a Domestic & General Services Limited protection plan for an Indesit or Hotpoint appliance, each individual customer (a "Participant") will receive electronic vouchers (Smart Care Vouchers) (which are provided by Whirlpool UK Appliances Limited) equal to the price of the protection plan.
  6. Participation in the Smart Care Scheme is for personal use only, and may not be used for any business purpose of any kind.
  7. All Participants must be resident in the UK and aged 18 years or older.
  8. Smart Care Vouchers cannot be transferred, bought, sold or in any other way traded by Participants. No cash alternative will be offered.
  9. Receiving Smart Care Vouchers

  10. Smart Care Vouchers will be credited by Whirlpool UK Appliances Limited to a personalised online voucher account on www.smartcarerewards.co.uk. This account can be accessed by Participant by logging on to www.smartcarerewards.co.uk with the plan number of the protection plan and their postcode.
  11. Smart Care Vouchers will be credited by Whirlpool UK Appliances Limited to a Participants' online accounts as follows:
    1. for each Indesit and/or Hotpoint protection plan purchased from Domestic & General Services Limited on or before 1st August 2015, a voucher value will be credited which is equivalent to the protection plan fee and the voucher value will be applied to the account full by Whirlpool UK Appliances Limited within 48 hours of 1st August 2015, whether the protection plan is paid in full or in instalments, by Direct Debit; and
    2. for each Indesit and/or Hotpoint protection plan purchased from Domestic & General Services Limited after 1st August 2015, including renewals of existing protection plans, a voucher value will be credited which is equivalent to the protection plan fee and the voucher value will be applied to the account in full by Whirlpool UK Appliances Limited within 48 hours of the sale or renewal (as appropriate) of the protection plan, whether the protection plan is paid in full or in instalments, by Direct Debit,
    3. (each to be considered a "Qualifying Purchase").
  12. Participants are solely responsible for ensuring that their protection plans (if more than one is purchased) are purchased using the same name and address. All plans purchased with the same customer name and address ("Customer Details") will have Smart Care Vouchers credited to one account. These Smart Care Vouchers can be used together. If Customer Details held by Domestic & General Service Limited and/or Whirlpool UK Appliances Limited are different, then Smart Care Vouchers will be credited to separate online accounts (which cannot be redeemed cumulatively).
  13. Neither Whirlpool UK Appliances Limited, nor Domestic & General Services Limited, have any obligations to issue or credit Smart Care Vouchers for any reason outside of the Qualifying Purchases set out in these terms and conditions.
  14. Redeeming Smart Care Vouchers

  15. Smart Care Vouchers are in the form of electronic vouchers and can only be redeemed online through the website www.smartcarerewards.co.uk (this website is operated solely by Whirlpool UK Appliances Limited).
  16. Please note that Smart Care Vouchers may only be redeemed against Indesit and Hotpoint appliances available on the website www.smartcarerewards.co.uk. Whirlpool UK Appliances Limited, nor Domestic & General Services Limited, provide any guarantee as to the availability of specific Hotpoint or Indesit appliances on the website www.smartcarerewards.co.uk.
  17. Participants may only redeem Smart Care Vouchers against a certain maximum percentage of the overall cost of a Hotpoint or Indesit appliance made available for purchase on the website www.smartcarerewards.co.uk. This maximum percentage varies by appliance and is clearly shown on the website. The percentage will not be less than 10% or more than 50% of the appliance's value.
  18. Smart Care Vouchers must be redeemed within 12 months from the day on which they are credited on a Participant's online voucher account.
  19. If a Participant redeems any Smart Care Vouchers and subsequently cancels the associated protection plan within 30 days of such Smart Care Voucher redemption, the Participant shall be required to pay to Whirlpool UK Appliances Limited the value of such redeemed Smart Care Vouchers, such payment to be made within 30 days of the date of invoice from Whirlpool UK Appliances Limited.
  20. Participants are under no obligation whatsoever to redeem Smart Care Vouchers at any time.
  21. Smart Care Vouchers becoming void

  22. In the event that a Participant cancels a Qualifying Purchase for any reason, the Participant will not be entitled to redeem Smart Care Vouchers issued in respect of the cancelled Qualifying Purchases, and any already issued/credited Smart Care Vouchers will become void.
  23. Smart Care Vouchers will also become void in circumstances where Domestic & General Services Limited cancel a Participant's plan in accordance with the terms of a protection plan (unless a Participant's protection plan terminates due to a replacement or contribution towards a replacement being provided under the protection plan, in which case Smart Care Vouchers issued in respect of such protection plans will not become void).
  24. Whirlpool UK Appliances Limited and/or Domestic & General Services Limited may also decline to issue/credit, void or cancel Smart Care Vouchers in the following circumstances:
    1. there is a reasonable belief of dishonesty and/or abuse or attempted abuse of the Smart Care Loyalty Scheme; and/or
    2. there is a reasonable belief of breach or attempted breach of these terms and conditions.
  25. Limits, exclusions and caps on our liability

  26. If Domestic & General Services Limited and/or Whirlpool UK Appliances Limited fail to comply with these terms and conditions, each party will only be responsible for loss or damage Participant's suffer that is a foreseeable result of Domestic & General Services Limited and/or Indesit Company UK Limited's breach of these terms and conditions and/or their negligence. Neither Domestic & General Services Limited, nor Indesit Company UK Limited is responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of a breach or if they were contemplated by the Participant, Domestic & General Services Limited and Indesit Company UK Limited at the time the Smart Care Loyalty Scheme was launched.
  27. Domestic & General Services Limited and Whirlpool UK Appliances Limited only provide the Smart Care Loyalty Scheme for domestic and private use and will therefore have no liability to Participants for any loss of profit, loss of business, business interruption or loss of commercial opportunity under these terms and conditions.
  28. Domestic & General Services Limited and Whirlpool UK Appliances Limited's maximum aggregate liability under these terms and conditions is limited, in respect to each Participant, to the value of Smart Care Vouchers credited to their online account.
  29. By participating in the Smart Care Loyalty Scheme, all Participants acknowledge that notwithstanding the redemption of Smart Care Vouchers, all contracts entered into for the supply of Hotpoint and/or Indesit products from the website www.smartcarerewards.co.uk will be between the Participant and Indesit Company UK Limited only. On the basis that Domestic & General Services Limited will not be party to such contracts, Domestic & General Services Limited accept no liability whatsoever for the purchase or supply of such products.
  30. Other important terms

  31. Whirlpool UK Appliances Limited and/or Domestic & General Services Limited may make changes to these terms and conditions at any time (including termination of the scheme altogether). As much prior notice will be provided to Participants of such changes. In circumstances where the scheme is terminated, all online voucher accounts will be suspended immediately.
  32. Whirlpool UK Appliances Limited and/or Domestic & General Services Limited obligations under these terms are subject to English law and the non-exclusive jurisdiction of the English courts.
  33. A person who is not a party to these Terms & Conditions shall have no right under the Contract(Rights of Third Party) Act 1999, but this shall not affect any right or remedy of a third party which otherwise exists or is available.
